Tính thời gian ký hợp đồng lao động

Tôi làm cho cơ quan đã được 1 năm, bây giờ mới bắt đầu ký HĐLĐ. Vậy có thể làm HĐLĐ căn cứ theo ngày tôi bắt đầu làm cách đây 10 tháng (trừ 2 tháng thử việc) hay không?

 Căn cứ Nghị định số 44/2003/NĐ-CP ngày 9 tháng 5 năm 2003 của Chính Phủ , quy định chi tiết và hướng dẫn thi hành một số điều của Bộ luật Lao động về hợp đồng lao động.
 
Khi ký kết hợp đồng lao động hai bên phải thoả thuận cụ thể ngày có hiệu lực của hợp đồng lao động và ngày bắt đầu làm việc. Trường hợp người lao động đi làm ngay sau khi ký kết hợp đồng lao động, thì ngày có hiệu lực là ngày ký kết. Trường hợp người lao động đã đi làm một thời gian sau đó mới ký hợp đồng lao động hoặc hợp đồng lao động miệng, thì ngày có hiệu lực là ngày người lao động bắt đầu làm việc.
